The Supreme Court will hear arguments next month on a Trump administration plan to limit birthright citizenship, a major test of the 14th Amendment’s reach.
The high court agreed Thursday to review lower court rulings that blocked the administration from enforcing an executive order denying automatic citizenship to children born in the United States to illegal immigrants.
At least four orders from federal courts across the country have indicated Trump’s plans would violate the Constitution’s citizenship clause, which guarantees birthright citizenship to “all persons born or naturalized in the United States.”
The administration argued that the clause was never intended to apply to children of parents who are unlawfully in the country. If upheld, the policy would reverse decades of immigration precedent.
