Judges cannot hold ‘the entire country hostage’ through injunctions: Josh Hawley

Sen. Josh Hawley (R-MO) spotlighted the issue with federal district judges ruling against the Trump administration’s deportation efforts, arguing judges’ use of nationwide injunctions cannot be used on a national scale.

Hawley argued that while federal judges do have the power to issue injunctions to force specific parties to take a certain action, a power that is granted to them through Article III of the Constitution, the injunctions can only be issued “to the parties in front of them” and not the entire nation as has been seen with judges’ injunctions against the Trump administration.

“They cannot go out and say, ‘You know what? I think I’m just going to issue an injunction that holds the entire country hostage to my will,’” Hawley explained on Fox News’s The Faulkner Focus. “They can’t do that! The Constitution doesn’t allow them to do that, but they’re doing it anyway. Harris, they’ve done it 15 times against Trump in the month of February alone. Congress needs to fix this.”

The Missouri senator also rebuked the “whining and fussing” from Democrats over illegal immigrants not getting “full-dressed trials,” contending that they do not get the protections that citizenship offers since they are not in the country legally. He added that he has “no apologies” for his comment, as the Constitution does not extend its protections and rights to illegal immigrants, including those “committing acts of violence.”

On Monday, U.S. District Judge Edward Chen temporarily blocked the Trump administration from ending deportation protections for more than 600,000 Venezuelans, marking another roadblock for President Donald Trump’s deportation efforts. The judge, an appointee of former President Barack Obama, claimed that Homeland Security Secretary Kristi Noem’s rapid reversal of Biden-era protections includes “smacks of racism.”

Rep. Jim Jordan (R-OH) stated over the weekend that the House Judiciary Committee will be looking into  “left-wing activist judges.” Jordan also said the committee’s efforts were supported by some “justices on the Supreme Court who leaned to the Left.

Recent polling data has found that Trump’s stance on immigration is his most popular policy, getting 58% of approval from recipients. Trump also boasts a 50% approval rating from the data.
