Roy warns against taking ruling against Boasberg ‘to the bank’

Rep. Chip Roy (R-TX) expressed gratitude over the Supreme Court’s ruling that will allow the deportation of illegal immigrants to resume but argued that it is not a win the administration should take “to the bank.”

The Supreme Court’s 5-4 decision on Monday, which lifted U.S. District Judge James Boasberg’s temporary restraining order against the administration using the Alien Enemies Act, allows President Donald Trump to resume deporting alleged Venezuelan gang members with the 1798 statute. Roy argued that Trump is doing “the right thing” with his deportation of suspected gang members. The congressman also celebrated the Supreme Court’s ruling against the “activist judge” Boasberg for trying to stop the administration.

“My concern is that Amy Coney Barrett didn’t follow the majority, so there is one that voted the wrong way,” Roy assessed on Fox News’s The Faulkner Focus. “My other concern is that they said there needs to be a reasonable time for these folks to be able to go appeal their case, which means it’s going to go back to habeas cases, which means there’s going to be a churn on these cases. So, it’s good news, but it’s not something that we should take to the bank without changing.”

Due to the problems he spotlighted with the Supreme Court’s ruling, Roy, the Constitution and Limited Government subcommittee chairman, conducted a hearing on legislation that would limit the “abuses” that some judges are issuing via nationwide injunctions against the Trump administration.

Roy predicted that “leftist groups” will legally fight for illegal immigrants following the Supreme Court’s ruling, and they will argue that they were “rightfully released into the United States” due to the paroles the Biden administration “abused.” However, he reiterated that Trump is fulfilling his role as president to protect the U.S. from illegal immigrants, and the president deserves “great latitude” with his deportation efforts.

House Speaker Mike Johnson (R-LA) celebrated the Supreme Court’s ruling on Monday night, adding that Congress is working on getting Rep. Darrell Issa’s (R-CA) bill, the No Rogue Rulings Act, to the floor. Johnson said the legislation would keep federal district judges “in their constitutional lane.”

Sen. Eric Schmitt (R-MO) has argued that Boasberg “inserted himself” into the case against the Trump administration’s deportation efforts and called on Supreme Court Chief Justice John Roberts to investigate. He also said he would file legislation to enforce “randomness” when judges are assigned to cases.
